EARLY NEUTRAL EVALUATION
Early Neutral Evaluation (ENE) is a litigation avoidance process.
Used appropriately, it can result in significant cost and time savings
to the parties. If your case is headed to court, you may want to
consider using ENE before going forward.
Here's how it works. The disputants and their attorneys
meet with an evaluator. It is important that the evaluator is knowledgeable
about the subject matter of the dispute and an experienced trial
lawyer. The role of the evaluator is to listen to both sides and
to determine the strengths and weaknesses of each. The evaluator
then predicts the outcome should the case be litigated. The insight
provided by the evaluator is often enough to precipitate settlement.
Our office can arrange an evaluation of your pending litigation in any subject matter. Since we are choosing the evaluator, you can be assured that there is no conflict of interest or hidden agenda. We often bring in evaluators from out of town to insure that the process is conducted by a disinterested party. Weekend times are available. |
