MEDIATION
A Mediator does not make decisions, rather she explains the law and assists the parties to reach a resolution. In the case of a divorcing couple, Marilyn will draft the legal Separation Agreement which will include the decisions reached by the parties regarding custody, support and property distribution. The separate advising attorneys chosen by each of the parties will review the document before it is signed.

As an attorney and mediator with over 30 years of experience, Marilyn will work diligently and efficiently to facilitate settlement. Hourly rates apply to the mediation sessions and there is a flat rate for drafting the Agreement. The goal is to keep our clients out of court and to provide legal/mediation services in a professional, efficient manner.

REVOLUTIONARY NEW CONCEPT IN MEDIATION SERVICES - MEDIATION WITHOUT WALLS
(NO OFFICE VISITS)

Marilyn maintains an office for face-to-face meetings. However, most clients prefer to participate in mediation sessions by conference call. Each participant finds a convenient private place (each in a separate location). Calls can be set up for evenings or weekends as well as during the day. Documents are emailed, faxed, or sent by regular mail.

Clients save the time and money they would otherwise expend in driving to an office. In addition, many couples are more comfortable discussing custody, support and property distribution when they are not in the same room together.

Couples often find that they can keep a conference call appointments during the working day that would be impossible if office visits were required. The process is especially helpful when parties are separated geographically, for example when one person has already moved out of state, or is overseas on a military assignment.

Our goal is to offer a unique service which gets our clients through the separation and divorce process in a timely cost-effective manner.


WHEN IS MEDIATION APPROPRIATE?
Mediation can be used at any stage of a divorce or Family Court proceeding, or in any other circumstance when parties desire to settle their dispute out of court. Mediation is especially useful in cases where it is important to preserve a relationship with the other party. It is often the
only avenue available to couples who do not have any standing to petition a court. Mediation allows parents to separate while maintaining an amicable relationship for the sake of their children.

Some agreements reached through the mediation process are read into a court record and incorporated into an order signed by a judge. Separation Agreements are incorporated into final Judgments of Divorce.
